A May 2, 2013 decision by the Colorado Court of Appeals in Foster v. KTA-Tator, Inc. et al. unanimously affirmed a district court decision granting summary judgment to Greene Espel client Graco Inc. The lawsuit stemmed from an October 2007 explosion at the Cabin Creek Hydroelectric Plant in Georgetown, Colorado, which killed 5 workers and injured others. Just before the explosion, the workers sprayed epoxy inside an underground metal pipeline with a commercial Graco sprayer. Plaintiffs alleged defects in the manufacture, design and warnings associated with that sprayer under wrongful death, negligence and strict liability theories. The trial court found that there was no evidence that any defect in the sprayer caused the accident, and the Colorado Court of Appeals has now affirmed that decision.
