Greene Espel client wins dismissal of patent infringement claims

On Friday, October 2, 2009, Judge Montgomery of the United States District Court for the District of Minnesota granted Greene Espel’s motion to dismiss a patent infringement lawsuit brought against firm client J&S Fabrication, Inc., based in Pennsylvania. Ductcap Products, Inc. sued J&S in May 2009 for alleged infringement of a patent and sought damages, injunctive relief, attorneys’ fees, and other relief. While J&S was ready to demonstrate the patent’s invalidity and to prove that J&S did not infringe, it took the threshold step of pointing out to the court its lack of jurisdiction over J&S. Ductcap opposed the motion, but the court ruled in J&S’s favor.
