A recent decision by the Minnesota Court of Appeals in Grady v. Green Acres, Inc. unanimously affirmed a district court decision dismissing a lawsuit filed against Greene Espel client Green Acres, Inc. The plaintiff sued Green Acres after he was injured while snow tubing at Green Acres’ snow tubing hill.  In a case of first impression, the Court held that adults assume the risk of injury when snow tubing because the activity is “inherently dangerous.”
