A recent decision by the U.S. Court of Appeals for the Eighth Circuit affirmed the dismissal of a lawsuit filed against an Olmsted County prosecutor and sheriff’s deputy by a convicted sex offender who was arrested and charged with failure to register his winter address in Central America. The district court granted a motion for judgment on the pleadings on qualified immunity for the deputy and absolute prosecutorial immunity for the prosecutor, and the Eighth Circuit affirmed. Greene Espel attorneys John Baker and Jenny Gassman-Pines represented the defendants; Jenny Gassman-Pines argued the motion at the district court and the appeal at the Eighth Circuit.
