Greene Espel client FM Global, the world’s leading property insurance company, sought and won reversal of an approximately $35 million trial court judgment in favor of plaintiffs who had sued the company for an allegedly faulty inspection of the River Cities Business Park warehouse in Davenport, Iowa. The warehouse was destroyed by fire in February 2001.
In a unanimous decision handed down in June 2010, the Iowa Supreme Court reversed the trial court judgment and remanded the case for dismissal of all claims against FM Global. The Supreme Court found that there was no substantial evidence that anything FM Global did caused the fire or the fire’s spread, and that the damages being sought were not foreseeable as a matter of law.
