A May 31, 2013 ruling by the Minnesota Supreme Court in McCaughtry v. City of Red Wing unanimously rejected a facial challenge to the City’s rental-housing inspection ordinance. The lawsuit, brought by several landlords and tenants, stemmed from a dispute over the appropriate level of suspicion that must be met before a judge can issue an inspection warrant for a particular rental unit. The justices held that the appellants failed to show that the housing ordinance is unconstitutional in all of its applications, and affirmed the court of appeals’ decision in favor of the City.
