Client Win: Jury Returns Verdict in Favor of Greene Espel Client, Newsert

On Thursday, July 21, 2022, a federal jury in Minnesota returned a $1.2 million verdict for Greene Espel’s client, Newsert LLC, in the matter of Reach Companies, LLC v. Newsert LLC.

Newsert is a wholesale distribution company based in Cherry Hill, New Jersey. In March and April 2020, Newsert ordered almost $7 million in hand sanitizer from Reach to fill demand from Newsert’s customers. Newsert ordered these goods through a series of written purchase orders, prepaying in advance of shipments.

Newsert soon began experiencing late deliveries, unexpected price increases, and other issues. Newsert eventually canceled its outstanding orders and asked Reach to return unused prepayments. Reach refused to return the money, and it instead sued Newsert in federal court in Minnesota. Newsert counterclaimed for breach of contract. 

For four days, Greene Espel attorneys Mark Johnson and Aaron Knoll tried the case to a jury before Judge Eric Tostrud. After deliberating for a little over an hour, the jury rejected all of Reach’s claims and awarded Newsert almost $1.2 million on its counterclaims.
