Greene Espel attorneys Mark Johnson and Aaron Knoll tried the case to a federal jury in July 2022. The jury rejected all of Reach’s claims and awarded Greene Espel client Newsert LLC $1.2 million on its counterclaim. (Read full story).
Reach moved for a new trial following a jury verdict, and after the Court denied that motion, Reach appealed to the Eighth Circuit, claiming a variety of errors in the original trial. After briefing and argument, the district court rejected that motion and upheld the jury’s verdict.
Reach appealed, and the Eighth Circuit has now affirmed Newsert’s trial win and the denial of Reach's motion for a new trial. In so doing, the court found no error in jury instructions, held that there was adequate evidence for the jury’s award of damages, and upheld the admission of evidence regarding a Reach witness’s past crimes involving dishonesty.
