On May 13, 2019, the First Circuit Court of Appeals issued a decision affirming the dismissal of a $22 million wrongful-death lawsuit brought against Greene Espel client Cargill, Incorporated. The lawsuit had been filed in court—but not served on Cargill—before the statute of limitations expired, and was not served during the 90-day period provided by Massachusetts law. The appellate court agreed that the 90-day service deadline was mandatory unless a party established good cause and affirmed the district court’s conclusion that the plaintiff had not established the necessary good cause for failing to meet the deadline.
