Greene Espel attorney Jenny Gassman-Pines has co-authored an article for MSBA’s Bench & Bar of Minnesota. The article, titled “Examining the SCOTUS decision’s impact on employment law and DEI programs,” analyzes the April 2024 U.S. Supreme Court decision Muldrow v. City of St. Louis, which addressed the standard for bringing a Title VII claim. Jenny and her co-authors discuss how the decision could open the door for more workplace discrimination claims and embolden employees to challenge diversity, equity, and inclusion programs at their workplaces, regardless of those program’s aims. The article then offers ways for employers to prepare for those challenges as well as how to ensure their organization’s diversity, equity, and inclusion efforts are legally compliant and afford opportunities for all.
